Section 1: Amendment to the Covenants and Restrictions

Overview: This proposed release is required by many mortgage holders before they will lend on real estate. This paragraph was inadvertently left out of the 2013 covenants and restrictions update.

Proposed: Subordination of the Lien to Mortgages The lien of the assessments provided for herein shall be subordinate to the lien of any mortgage or mortgages now or hereinafter placed upon the properties subject to assessment; provided, however, that such subordination shall apply only to the assessments which have become due and payable prior to a sale or transfer of such property pursuant to a decree of foreclosure, or any other proceeding in lieu of foreclosure.  Such sale or transfer shall not relieve such property from liability for any assessments thereafter becoming due, nor from the lien of any such subsequent assessments. 

Board Recommendation: The Board of Directors recommends approving this amendment. This is the exact language from the 1982 document.

Impact: No financial impact to the Association. Increases owners ability to borrow money on their home including first mortgages and home equity loans.

Note: 67% of the owners must approve this initiative for this transaction to be completed. Please vote.

Section 2: Capital Repair Approval

Capital Repairs: The are two capital repair projects that are needed this year - the replacement/repair of the brick entry wall and the replacement/repair of the mailbox clusters. Both are included in the capital repair plan approved by the owners and these repairs have no impact on the 2014 monthly dues rate.


Proposal A: Repair of the Mailboxes

Overview: There is one rotted mailbox pedestal that need to be replaced. Repairs to the mailboxes are in the capital plan approved by the owners.

Proposed: It is proposed to that the Association replace one rotted pedestal and paint and clean the mailboxes. .

Board Recommendation: The Board of Directors recommends this spending at this time.

Impact: The Post Office will not deliver to a broken distal. This expense will be drawn from the capital reserves - there is no impact on monthly dues rate.

Proposal B: Miscellaneous Repairs to Railings, Marble, and Letters at the Entry

Overview: There are three repairs needed at the entry. Repairs to the entry are in the capital plan approved by the owners.

Proposed:

1. Repair of a rotted section of iron railing. This repair will and prevent the railing from falling and stop further damage (click on photo to enlarge).

2. Reattach the marble tiles that have come loose. The marble tiles have separated from the wall. This repair will stop the tiles from falling and prevent further separation.

3. Correct the mismatching colors in the name plate. This will be done by moving two letters from one sign to the other and purchasing 3 new letters.

Board Recommendation: The Board of Directors recommends this expenditure.

Impact: Doing the work in 2014 will prevent further rusting and separation of the tiles and more costly repair at a future time. This expense will be drawn from the capital reserves - there is no impact on monthly dues rate.

Section 3: 2014 Budget / Dues Rate and Special Projects

In both 2013 and 2014 the owners must repay $2,489 to the Emergency Reserve (self insurance reserve) as required by the Covenants and Restrictions Declaration. This is repayment for emergency spending in 2012 for a water meter required by the City of Irving.

The assessment amount needed to cover basic expenses for management accounting, audits, taxes, insurance, and the routine annual maintenance obligations guaranteed to every home owner by the Covenant and Restriction Declaration, plus payments into the Reserves is $81.00 per month ($243 per quarter). The increases over 2013 are primarily increased paint and maintenance expenses related to the larger paintable surface on Brentwood Court homes and the extent of repairs needed and an increased landscaping expenses.

The 2013 actual spending is available here. The Association came in under the expense budget (there were no spending overruns) .

The following additional projects (see below, if approved, will be additive to the 2013 rate stated above.


Discretionary Expense Option: Wheelchair Ramps at North and South Mailboxes

Overview: This owner sponsored initiative is to add wheelchair ramps at the mailboxes. This initiative was submitted by owners at large.

Proposed: It is proposed to install 25 foot long concrete ramps at the mailbox clusters on the north and south end of the property, The project includes concrete paving, relocation of irrigation heads, relocation of 1 lamp post, and the repositioning of 4 mailboxes.

Background: The post office will deliver mail to the door of any person with a documented physical disability. The HOA is not required to install ramps under the ADA or FFHA.

Mail Delivery to Physically Handicapped Act ("MDPHA"). The MDPHA provides the service of mail being brought to an owners door as opposed to being deposited in a mailbox at the street or cluster. The application needs to include a certificate from a licensed physician stating that the resident is physically handicapped to the extent that anything other than door delivery would pose a medical or physical hardship. For door mail deliver to begin, approval by the local Post Master is required.

Americans with Disabilities Act ("ADA") An HOA will not be subject to the ADA unless the HOA is operating what can be considered a "public accommodation." A "public accommodation" is any facility which a HOA is holding out for use by members of the general public--not solely for use by the HOA's members and their guests.

Federal Fair Housing Act ("FFHA") The FFHA also requires HOAs to permit a disabled owner to make, at such owner's expense, reasonable modifications to the owner's unit and HOA common areas

Impact: A 2014 installation will add $2.80 to the month dues rate

Section 4: Select two owners to serve as directors
Two director positions are available to replace Shirley Otrodovec and Jeff Waldrum who are unable to complete their 2013-2014 terms. Randy Ranew (vice president), Robert Bauer (treasurer), and Vivian Scott will complete the second year of their 2013-2014 term.

I was glad to step into Jeff Waldrum's 2013 term and manage the lamp post repair and lamp post maintenance projects this year. I've been an owner for 13 years, consider myself a "hands on guy", and will do my best to continue the positive direction the Association is on. I have been serving as President since November and have agreed to serve as President for 2014 if elected by the owners and confirmed by the board. ~Chad Johnson

Section 5: Safety Renovations Funded by TxDOT

Overview: The Association successfully petitioned the State of Texas for $25,000 to make safety changes to the exit onto Highway183.

Proposed: The plan is to relocate the traffic spikes to the required 30 foot setback, to lower the screening wall to see oncoming traffic, to relocate the electrical services, and add high visibility signage/lights to prevent highway traffic from entering.

Board Recommendation: The Board of Directors recommends this expenditure. Doing the work in 2014, before road construction, has both tax advantages and cost advantages.

Impact: Funded by TxDOT. No impact on monthly dues rate or the capital reserve. This is a self funded project.

Section 6: Opinion Survey

Will you likely attend the community block parties

Special thanks to Anna Lankford and the 9 other homeowners who sponsored and won a grant from the City of Irving. Beverly Oaks Association and the City of Irving are now partnering to host two block parties in 2014. The City of Irving is reimbursing the majority of the expense provided the owners supply 37 hours of labor for the event.

How valuable is the volunteer planting program

Over the last five years, Association volunteers have brokered shrubs and sod at wholesale prices ($7.95 per plant) with free planting for owners that had dead shrubbery and grass. More than 200 shrubs were planted and 30 pallets of sod laid. All the savings were passed on to the owners. This is compared to a $35.00 price per plant offered by the landscapers. This improved the participating homes and the community look for all.

Last years the Association volunteers brokered 91 window replacements at approximately 50% of the retail price with all the savings passed on to the owners.. This improved the participating homes and the community look for all.
