The Beverly Oaks Association is a Texas Corporation that owns and operates the essential common properties of the community (e.g.., water mains, sewer, streets), provides property services to each homeowner (e.g., landscaping and painting). and guides owners in maintaining the architectural consistency of each duplex, triplex, and fourplex (e.g., similar garage doors, roofs).

The Association and Owners are contractually co-obligated to one another - one party to pay assessments and the other to provide services mandated in the deed restrictions. The Declaration of Covenants and Restrictions for Beverly Oaks Townhouses is the contract between the Association and owners and it establishes the rights, obligations, and recourse of all parties. The Declaration of Covenants and Restrictions for Beverly Oaks Townhouses was filed for record on February 5, 2013 as instrument number 201300037131 in the public records of Dallas County, Texas.

Infrastructure Repairs


The Association owns and maintains the essential common area assets of the Beverly Oaks subdivision which include the incoming water mains and outgoing sewer lines, the storm drains running under the subdivision, the Brentwood and Wilshire roadways, the 2023 Wilshire building, the irrigation system, the exit alley, traffic spikes and traffic warning lights, the concrete screening walls separating the subdivision from the multifamily property to the west and commercial properties to the north, and the fire hydrants and mailboxes.

The Association maintains these assets in accordance with standards set by Irving's departments of Code Enforcement, Water, Environmental Compliance, and the Fire Marshall. Failure to meet these standards can result in community fines, discontinuation of services, evacuations, or condemnation of the property.

It is the Association's responsibility to (1) set aside reserves (savings) to fund future maintenance and keep the properties up to standards, to (2) have a formal long term maintenance plan and budget, and (3) to purchase insurance and have emergency plans in place to respond to unexpected failures. As part of this effort the Association conducts engineering studies to determine the funding needed for future repairs, such as roadway repairs.. The current study estimates maintenance costs over the next 30 years to be $1.6 million.

Painting, landscaping, and lighting

The Association is contractually obligated to provide maintenance services as listed in the Covenants and Restrictions Declarations.

These services include lawn mowing, irrigation, fertilization, tree trimming, exterior painting/siding and routine maintenance of the light bulbs and electric eyes associated with the front yard pole lamps - things that the community has agreed can be managed more efficiently and cost effectively when purchased en masse.

The Association also coordinates periodic bulk purchases in which the Association contracts services at a deeply discounted price and sells the services to owners at cost and passes the discounts to owners. Examples of this include planting weekend which facilitated the installation of over 500 shrubs since 2009, lamp post replacement week which has resulted in the replacement of 17 broken lamp posts, and the window replacement program which lead too the installation of 126 windows in 2013 and 2016.

Architectural Coordination

The Association monitors and enforces homeowner compliance to community standards established to maintain the value of the homes and keep the community looking good. Standards have been set for roofing, exterior siding, front doors, garage door, windows, exterior fixtures, and the flow of rain water over the surface - homeowners cannot erect structures that change the flow of surface water drainage.

Since 2009 there has been significant effort to resolve the mismatching roof colors and garage door patterns. As part of this, the Covenant and Restriction Declarations were amended to legally require owners to get Association Approval prior to exterior construction or repairs. In all cases, written approval by the Board of Directors i required prior to the delivery of materials and the commencement of work. The purpose of this approval is to insure that Members are aware of the building standards and design requirements and to prevent BS&DS violations. Ignorance of the Building Standards and Design Requirements is not a basis for a waiver.
